TERMS OF USE

Mwongozo wa Africa Travel Ltd

1. Introduction

These Terms of Use govern your use of the services provided by Mwongozo wa Africa Travel Ltd (“Mwongozo wa Africa Travel”, “we”, “us”, or “our”).

By requesting, booking, purchasing, or using our services, you acknowledge that you have read, understood, and agreed to these Terms of Use.

2. Our Services

Mwongozo wa Africa Travel Ltd provides travel-related services, which may include:

·       Flight ticket bookings

·       Hotel and accommodation bookings

·       Visa assistance

·       Airport transfers

·       Travel insurance arrangements

·       Cruise bookings

·       SGR and other transportation bookings

·       Tour packages and travel arrangements

Services are subject to availability, supplier terms, applicable laws, and the specific terms communicated to the customer at the time of booking.

3. Bookings and Reservations

All bookings are subject to availability and confirmation by the relevant airline, hotel, transport provider, tour operator, cruise company, insurer, or other service provider.

A booking is considered confirmed only after Mwongozo wa Africa Travel Ltd has received the required payment or deposit and issued confirmation, where applicable.

Customers are responsible for providing accurate names, passport details, travel dates, contact information, and other information required for a booking.

Errors in information supplied by a customer may result in additional charges, booking changes, cancellation, or loss of services.

4. Prices and Payments

Prices quoted by Mwongozo wa Africa Travel Ltd may change until a booking is confirmed and payment is received, particularly where supplier prices, taxes, exchange rates, or availability change.

Unless otherwise stated, quotations are subject to the terms and validity period stated in the quotation.

Customers are responsible for paying the full amount or required deposit by the agreed deadline.

Additional charges may apply for amendments, cancellations, rebooking, baggage, visa services, transfers, taxes, or other services depending on the supplier's terms.

5. Airline, Hotel and Supplier Terms

Travel services are supplied by third-party providers. Airlines, hotels, cruise companies, transport operators, insurers, and other suppliers may have their own terms, conditions, cancellation policies, baggage rules, refund rules, and restrictions.

Where applicable, those supplier terms also apply to your booking.

Mwongozo wa Africa Travel Ltd does not control the policies, schedules, prices, availability, or operational decisions of third-party suppliers.

6. Cancellations, Changes and Refunds

Cancellation, amendment, rebooking, and refund conditions depend on the relevant supplier and the type of service purchased.

Some tickets, hotel reservations, tour packages, visas, insurance products, and other travel services may be non-refundable or may attract cancellation or amendment charges.

Any refund received by Mwongozo wa Africa Travel Ltd from a supplier will be processed in accordance with the applicable booking terms and after deduction of any permitted charges or fees.

Customers should review the cancellation and refund conditions before making payment.

7. Visa Assistance

Where Mwongozo wa Africa Travel Ltd provides visa assistance, we assist with the application process and documentation based on information supplied by the customer.

Visa approval is determined solely by the relevant embassy, consulate, immigration authority, or other competent authority.

We do not guarantee visa approval, processing times, entry into a country, or the outcome of an immigration decision.

Customers are responsible for providing truthful, complete, and valid information and documents.

8. Travel Documents and Customer Responsibility

Customers are responsible for ensuring that they have valid passports, visas, permits, vaccination certificates, travel insurance where required, and other documents necessary for their journey.

Customers should verify entry requirements, passport validity, transit requirements, baggage rules, and other applicable travel conditions before departure.

Mwongozo wa Africa Travel Ltd may provide information and assistance but does not replace the requirements or decisions of government authorities and travel suppliers.

9. Travel Insurance

Travel insurance may be arranged upon request.

Customers should carefully review the policy terms, exclusions, coverage limits, claims procedures, and conditions provided by the insurer.

Mwongozo wa Africa Travel Ltd is not the insurer and does not determine whether a claim is accepted or paid.

10. Travel Disruptions and Force Majeure

We are not responsible for losses, delays, cancellations, or additional costs arising from circumstances beyond our reasonable control, including severe weather, natural disasters, pandemics, strikes, civil unrest, government restrictions, border closures, technical failures, supplier insolvency, or other extraordinary events.

Where possible, we will assist customers in communicating with the relevant supplier and exploring available alternatives, subject to the supplier's policies and availability.

11. Customer Conduct

Customers must provide accurate information and must not use our services for unlawful, fraudulent, or misleading purposes.

Customers must treat our employees, agents, suppliers, and other customers respectfully.

We reserve the right to decline or terminate services where there is reasonable evidence of fraud, abuse, unlawful conduct, or material violation of these Terms of Use.

12. Limitation of Liability

To the extent permitted by applicable law, Mwongozo wa Africa Travel Ltd is not responsible for losses caused directly by the acts, omissions, delays, cancellations, failures, or decisions of third-party travel suppliers.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Where we are responsible for a service arranged directly by us, our liability will be subject to applicable law and the specific terms of the relevant service.

13. Complaints and Disputes

Customers should raise complaints with us as soon as reasonably possible so that we can assist in resolving the matter.

Where a complaint concerns a third-party supplier, we may need to refer the matter to that supplier in accordance with its complaint or claims procedure.

These Terms of Use are governed by the laws applicable in Kenya, unless applicable law requires otherwise.

14. Privacy

Personal information provided to us is handled in accordance with our Privacy Policy and applicable data-protection laws.

By using our services, you acknowledge that certain information may need to be shared with airlines, hotels, transport providers, visa authorities, insurers, payment providers, and other relevant service providers to fulfil your requested travel arrangements.

15. Intellectual Property

Unless otherwise stated, content, branding, logos, text, graphics, and other materials produced or used by Mwongozo wa Africa Travel Ltd remain our property or are used with permission.

You may not reproduce, modify, distribute, or use our materials for commercial purposes without our prior written permission.

16. Changes to These Terms

We may update these Terms of Use from time to time to reflect changes to our services, business practices, or applicable legal requirements.

The version applicable to a booking will generally be the version in effect when the relevant service is purchased, unless otherwise required by law or agreed in writing.
